4th of July Fireworks Regulations

FIREWORKS ORDINANCE NO. 543-03

 

 “Fireworks”:  Explosive devices designed primarily to produce visible or audible effects by combustion, deflagration, or detonation.  This term includes aerial devices of explosive composition or ground devices of explosive composition, all of which are classified as Class C explosives by regulation of the United States Department of Transportation;

                                               

Sale of fireworks prohibited. It shall be unlawful for any person to permit or conduct the sale of fireworks within the City Limits of New Bloomfield, Missouri, except during the following dates: June 27th - July 5th.  A business license is required by anyone selling fireworks in city limits.

 

Discharging of fireworks prohibited.  At the discretion of the Mayor, fireworks may be banned on a year by year basis due to weather related conditions such as lack of rain or drought.  Notification shall be posted at all local posting sites.   

 

Use or discharge of fireworks.   It shall be unlawful for any person to use or discharge fireworks within the City Limits of New Bloomfield, Missouri, except during the following permitted dates and times:

 

·        When July 4th falls on a weekday (Monday through Friday), it shall be legal to discharge fireworks on the Friday before the 4th through the Sunday after the 4th.

·        When July 4th falls on a Saturday or Sunday, it shall be legal to discharge fireworks the weekend before the 4th (beginning Friday) through the weekend of the 4th (on Sunday).

·        It shall be legal to discharge fireworks during the above permitted dates from 8 a.m. to 10 p.m. with the exception of July 4th (Independence Day) and December 31st (New Year’s Eve), when the discharge period will be extended from 10 p.m. to 12 a.m.

 

 Parents responsible for minors.  It shall be unlawful for the parent or guardian of a minor under the age of (17) seventeen years to permit such minor to violate the fireworks provisions established in this ordinance.

 

Disposal of unfired fireworks  Unfired fireworks and trash that remain after any use of fireworks is concluded shall be immediately disposed of in an approved, safe manner by all parties responsible for the use of the fireworks resulting in unfired fireworks and trash.

 

Seizure of fireworks  The New Bloomfield Police Department shall seize, take, remove, or cause to be removed at the expense of the owner, all stocks of fireworks that are offered or exposed for display or sale, are stored or are being used or discharged in violation of this ordinance.

 

Penalties. Any person violating the provisions of this ordinance is guilty of a misdemeanor and upon conviction thereof, shall be fined not more than five hundred dollars ($500.00) and/or sentenced to no more than 90 days in jail.  Each day that a person fails to comply with this ordinance may be deemed a separate offense.
